Insolvency Advisory & Litigation Support Fincap has actively been filing Petitions on behalf of clients that fall in the category of Financial Creditors or Operational Creditors under the Insolvency & Bankruptcy Code, 2016 (IBC). These Petitions are filed in the National Company Law Tribunal (NCLT) against Bodies Corporate both Private & Public and Limited Liability Partnerships (LLPs). We have established a Pan India network to file Petitions throughout the country such as Mumbai, Kolkata, Hyderabad, Chandigarh, Bengaluru, Allahabad etc.

  • Financial Creditors predominantly include Individuals/Firms/Partnerships/Bodies Corporate that have advanced loans, guarantees (including Personal Guarantees). The recent June 2018 Ordinance passed has amended the IBC to include Home Buyers as Financial Creditors. Therefore, Individuals/Firms/Partnerships/Bodies Corporate that have booked properties with Developers who are not giving possession or refunds to customers can file Petitions to declare them insolvent.
  • Operational Creditors include payments that are overdue for supply of goods and services. However, Individuals/Firms/Partnerships/Bodies Corporate that have already filed civil proceedings against the proposed Corporate Debtor are precluded from filing NCLT Petitions as this is construed to be forum shopping and the NCLT does not interfere in such matters. However, consumer fora and criminal proceedings can continue alongside the IBC.

The IBC is a draconian statute that ensures that in the event the Corporate Debtor is admitted to insolvency, the Board of Directors is superseded and the Managing Director’s powers are withdrawn completely. The Insolvency Resolution Professional (IRP) takes over the management of the Corporate Debtor and the entire insolvency resolution is to be completed in a time bound manner – 180 days under the law with another 90 days extension that is only possible through the NCLT’s approval.

Our core team consists of highly skilled and professional Legal Experts and qualified Chartered Accountants - that have licences to act as Insolvency Resolution Professionals. India’s economic reforms are gathering momentum and the IBC is clearly a paradigm shift from debtors to creditors in control.
